Rob Hughes examines Pennsylvania Superior Court rulings that may expand design firm liability

In an op-ed article for The Zweig Letter, Rob Hughes, senior vice president and partner, Ames & Gough, examines two rulings by Pennsylvania’s Superior Court that may expand liability for design firms operating in Pennsylvania. The first opinion, Truax v. Roulhac, involved a bodily injury claim sustained by a pedestrian and suggests that designing to code might not be sufficient to protect an A/E firm from potential liability. The second opinion, Gongloff Contracting L.L.C. v. L. Robert Kimball & Associates, Architects and Engineers Inc., erodes Pennsylvania’s interpretation of the economic loss doctrine.
